Industry associations and professional service providers — including chambers of commerce, law firms, accounting firms, and financial institutions — must support overseas investment through information services, market development, financing, insurance, and dispute resolution, while adhering to relevant compliance standards.
Article 5 of the regulation sets clear standards for responsible investment. Investors must comply with local laws and international practices, respect local customs, and fulfill social responsibilities. The regulation explicitly prohibits activities that damage the ecological environment, infringe on workers' rights, jeopardize national security, or harm public interests.
This signals a clear shift: investment outcomes are no longer measured by capital deployment alone. Environmental practice, host-country acceptance, social legitimacy, and credible risk management now carry equal weight.
The regulation frames overseas investment as part of China's role in global economic governance. Article 4 commits China to align with international economic and trade rules, promote high-quality Belt and Road cooperation, build multilateral investment cooperation mechanisms, and help shape international investment rules.
According to the Institute for Governance & Sustainable Development (IGSD), the regulation "marks an important step in China's efforts to strengthen its overseas investment management system and reputation," with important implications for advancing "higher-quality, better-regulated, and more responsible overseas engagement."
For Chinese companies already operating abroad or planning cross-border expansion, the immediate priorities are clear: review existing compliance frameworks against the new standards, strengthen environmental and social risk assessments for overseas projects, and ensure all approval and filing procedures are fully documented. Professional service providers — legal, accounting, and risk advisory firms — are expected to see increased demand as investors adapt to the heightened regulatory environment.
The regulation comes at a time when global investment screening mechanisms are tightening worldwide. The EU's new FDI Screening Regulation (EU 2026/1386), published in June 2026, similarly mandates screening mechanisms across all 27 member states with a common minimum sectoral scope. This convergence of regulatory approaches underscores the growing importance of compliance-first international investment strategies.
